行政司法审查中仅以狭义"违反法定程序"为依据不能圆满的保障行政相对人的合法程序权利,法院可通过以"违反法定程序"作为裁判依据,同时将正当程序原则通过目的解释以论证说理的方式充实到法定程序中,弥补立法不足,其具有行政司法审查适用的必要性和可行性,进而推动行政程序法治的进程,加强对行政相对人程序权利的保障。

The administrative judicial review can not satisfactorily protect the legitimate procedural rights of the administrative counterpart on the basis of the narrow ＂ violation of the statutory procedure＂.The court may,through justifying the principle of due process through justification by justifying the principle of due process,The method is enriched in the legal procedure,making up for the lack of legislation,having the necessity and feasibility of the application of administrative judicial review,and further promoting the progress of the rule of law in the administrative procedure and promoting the protection of procedural rights of the administrative counterpart.
