摘要
"一带一路"沿线各国的新利益诉求、法治化水平及区域内的法律现状对"一带一路"建设提出了新的法律需求。受全球治理方式变革的影响,"一带一路"建设宜采用强制型供给和诱致型供给相结合的法律供给方式,具体包括条约、示范法及其他软法形态。在法律供给进路上,既要立足立法,又要强调司法。在立法上,应结合"一带一路"建设实际,以投资贸易法为重点;在司法上,应加强沿线国家的司法合作,妥善处理司法管辖权冲突,完善外国判决的承认与执行等。
Several issues including new interest requests, the level of legalization as well as the legal situation in the ＂ Belt and Road＂ region trigger demands of new law. Affected by transformation of global governance, it is better to take a combination of enforcement - type supply and supply - induced type as the legal supply method in the ＂ Belt and Road＂ establishment. Conventions, modal laws and other types of soft laws can be chosen as the legal sources when supplying new law. The supply approaches consist of legislation and adminis- tration of justice. The former should focus on the investment and trade law; and the latter needs to take judicial assistance and cooperation into consideration.
