“一带一路”倡议下文化遗产法中文化多样性价值的确立

The Establishment of Cultural Diversity Value in the Cultural Heritage Law under "The Belt and Road" Initiative

"一带一路"倡导多元文化互学互鉴、树立中华民族文化自信,这对我国文化遗产工作提出更高要求。文化遗产工作离不开法治的引领和保障,而文化遗产法的价值界定繁多,缺少统一的价值名目,对"一带一路"建设产生不良影响。"文化多样性"是人类学研究的产物,同时也是《世界文化多样性宣言》等国际公约确认的法律概念,它能够突出文化遗产法的学科特点,满足人类的实际需要,具有合法性意义。我国应当将"文化多样性"作为文化遗产法的价值。现阶段我国文化遗产立法仅停留在文化遗产保护行为层面,缺少深层价值构建,相关立法模式与内容过于松散,未与国际法接轨,因此,我国应制定文化多样性保护法,在部门法中确立多元文化发展原则和文化遗产权,从而与"一带一路"所倡议的文化包容精神相契合,完成中华民族优秀传统文化保护、传承与发展的历史使命。

Cultural heritage cannot do without the direction and guarantee of the rule of law, which, featuring diversified definitions of values and lack of unified value items, has adverse effects on the The Belt and Road construction. ＂ Cultural diversity＂ is a product of anthropology research, but also the legal concept of international law. ＂ Cultural diversity＂ highlights the cultural heritage law subject characteristics, meets the actual needs of human beings, and has legal significance. Therefore, our countl7- should take ＂ cultural diversity＂ as the value of cultural heritage law. At the present stage, China＇s cultural heritage legislation only stays at the level of cultural heritage protection, lacks deep value construction, and the relevant legislative modes and contents are too loose, which is not in line with international law. China should establish the law of cultural diversity protection, the principle of muhicuhural development in relevant departments, and the right of cultural heritage. We should uhimately establish the cultural confidence of the Chinese nation to accomplish the historical mission of the protection, and carry on the development of Chinese excellent traditional culture.
