摘要
《食品安全法》直接或间接的赋予了疾控机构食品安全风险监测评估、食品安全事故流行病学调查、食品检验、食品安全标准制修订及跟踪评价等多项职责。在全面依法治国、坚持厉行法治的新时代背景下,疾控机构如何切实履行《食品安全法》所赋予的法律义务值得探讨。通过分析疾控机构目前在履行《食品安全法》的过程中所存在的一系列问题,认为疾控机构要履法到位,需在强化法律认知、明确职责分工、加强部门配合、提升技术能力、改进管理水平等方面做出努力。
The Food Safety Law has endowed disease prevention and control institutions with many duties such as food safety risk monitoring and assessment, food safety accident epidemiological investigation, food inspection, food safety standard enactment and revision, tracking and evaluation. In the new era where law - based governance of the country and the rule of law are adhered to, it is worth discussing how disease prevention and control institutions should earnestly fulfill the legal obligations specified by the Food Safety Law. By analyzing a series of problems in implementation of the Food Safety Law by disease prevention and control institutions at present, it is considered that the disease prevention and control institutions should implement the law in place by intensifying legal awareness, clarifying division of responsibilities, strengthening cooperation between departments, improving the technical capacity and elevating the administration level.
