摘要
例外,是法治结构中的不受法律约束的特殊悬法状态。在例外状态之中,法律不在场,但却被建构出它在场的虚假证明。阿甘本发现,今天所有的资产阶级民主国家都在利用将例外状态日常化和永久化的方式,建构起一种看不见的隐性极权主义。例外状态的常态化也是整个资产阶级政治法律秩序的失序。这种常态化和日常化的悬法状态,就是在今天在西方资本主义国家中随处可见的"紧急状态"、难民和收容所现象。
Exception is an iustitium which is not bound by a law in the structure of rule of law but it is in the state of exception.Absence of law,however,is constructed to falsify its presence.As it was found by Agamben,today all bourgeois democratic countries are building an invisible totalitarianism by means of normalizing and perpetuating the state of exception.The normalization of state of exception also refers to anomia of the whole bourgeois political and legal order.This normalized and routinized iustitium is the"state of emergency"with the phenomenon of refugees and asylums which prevails in Western capitalist countries today.
