我国民法典侵权责任编的编纂研究--我国《侵权责任法》修订入典的初步构想

The Preliminary Conception of Revising Tort Liability Law and Incorporating It into the Civil Code

按照全国人大的构想，我国民法典要设立侵权责任编，这就意味着，我国《侵权责任法》要经过修订而纳入民法典。在这一修订入典的过程中，立法者应当秉持实事求是的态度，不纠结于“大修”还是“小修”，而是当修则修，并且，应当兼顾“当下面向”与“未来面向”。我国民法典侵权责任编应当尽可能强化规范意义，作出比较细致、具有可操作性的规定。在我国《侵权责任法》修订编入民法典时，诸多具体的规则都需要完善，这尤其要从司法解释、法学研究成果、比较法、司法实践经验之中寻求灵感和智慧。

： According to the conception of the NPC （ National bility Volume shall be included in the Civil Code, and incorporated into the Civil Code. During such which means People＇s Congress） of China, the Tort Lia- that the Tort Liability Law will be revised process, the legislator shall take the down-to-earth atti- tude, not be entangled with the scope of revision, but make revision only when necessary and for both the present and future needs. The Tort Liability Volume of the Civil Code should strengthen the normative sig- nificance as far as possible and set out more detailed and operable provisions. In the process of revising and incorporating the Tort Liability Law into Civil Code, many specific provisions need to be improved, which in particular requires inspiration and wisdom sought from the judicial interpretation, academic research in law, comparative law and judicial practices.
