民营企业环境犯罪问题及对策

当今,民营企业是我国在现阶段带动国民经济发展,繁荣社会主义市场经济的重要板块。与此同时,民营企业在创造经济效益的同时,也带来一系列的问题,民营企业环境犯罪是其中的一个重大问题。目前,民营企业环境犯罪具有犯罪手段高度集中、犯罪模式呈产业化趋势以及社会危害性极大的特征。民营企业环境犯罪分为污染环境型、破坏生态系统型以及过度消耗环境资源型三大犯罪类型,具有长期性、隐蔽性的社会危害。为此,应当加大法制宣传力度,提升民营企业环境保护的法律意识,完善环境保护责任机制,加大监管力度,建立环保设备更新补贴制度及技术创新激励机制,坚决遏制对民营企业犯罪以行政处罚来代替刑罚,增加其违法成本,有效预防与打击民营企业环境犯罪,维护民营企业在法律框架内可持续性健康发展。

Nowadays,the private enterprises are the important plate of driving the development of the national economy and prospering the socialist market economy in our country at the present stage.At the same time,a series of problems brought about by private enterprises followed.Environmental crime of private enterprises is one of the major problems.At present,environmental crimes in private enterprises are characterized by highly concentrated means of crime,a trend of industrialization of crime patterns and great social harmfulness.Environmental crimes in private enterprises are divided into three types:polluting environment,destroying ecosystem and excessive consumption of environmental resources,which bring long-term and hidden social harm.Therefore,we should increase the publicity of legal system,enhance the legal consciousness of environmental protection in private enterprises,perfect the responsibility mechanism of environmental protection,strengthen supervision,establish the subsidy system of environmental protection equipment renewal and the incentive mechanism of technological innovation.
