摘要
环境规划是行政机关为实现既定的环境保护目标,对未来一定时期内拟开展的环境保护活动所作的部署与安排。从环境规划的法律特征来看,环境规划不属于行政指导,属于有别于其他典型行政行为的特殊行政行为。不能一概而论地把环境规划界定为抽象的行政行为,环境规划所具有的综合性、创造性、多样化特征决定了需要根据具体内容界定其行政行为类型。
Environmental planning is the deployment and arrangement of environmental protection activities,which planned for a certain period of time in order to achieve the established environmental protection goals.Environmental planning is not a part of the administrative guidance,but belongs to the administrative action from the perspective of legal characteristics of it.Taking environmental planning as abstract administrative action is inaccurate.The comprehensive,creative and diversified characteristics of environmental planning determine the need to differentiate it's legal nature.
