论肖像的可识别性及其判断

肖像具有可识别性是其受到法律保护的前提条件,不论是权利人请求行为人承担侵害肖像权的责任,还是权利人积极利用其肖像权,都以其肖像具有可识别性为前提。在判断肖像是否具有可识别性时,对于直接展现个人形象的肖像载体而言,可以通过将其与权利人对比的方式予以认定;对于非直接展现个人形象的肖像载体而言,应考虑权利人的社会知名度、社会交往范围,同时结合相关肖像载体所配文字、图片等,综合判断其是否具有可识别性。

The recognization of the portrait is a precondition for its legal protection. Whether the obligee＇s claims for compensation of the violated Right of Portrait,or he or she actively uses the Right of Portrait,the portrait, in both conditions, must be recognizable. In determining whether the portrait is recognizable,as for the portrait carrier directly displaying one＇s image, we can compare the portrait on the portrait carrier with the obligee. As for the portrait carrier indirectly displaying one＇s image, we should consider the obligee＇s reputation, social circles as well as the words and pictures used on the portrait carrier to determine whether the portrait is recognizable.
