农村土地三权分置下土地经营权流转问题研究

Study on the Land Management Right Transfer under Three Rights Division of Rural Land Theory

主要阐述在农村土地三权分置下,土地经营权流转形式日趋多样化、对象多元化、期限延期化的现状,提出了农村土地经营权流转存在农民进行土地经营权流转的积极性不高、流转机制不健全、行为不规范、流转市场化程度低的问题。最后,建议推动农村土地经营权流转应该引导农民群众充分了解土地流转政策;创新土地流转机制,调动农民的积极性;落实农村土地确权登记,规范和健全土地流转合同;建立和完善土地流转服务体系和市场运作机制。

This paper mainly described the present situation of form diversity, object diversity and term deferral in the ＂three rights division＂ of rural land theory. It put forward that the transfer of rural land management right existed lots of problems, including the initiative of peasants to transfer the land management right was not high, circulation mechanism was not perfect, behavior was not standardized, degree of tranfer marketization was low. Finally, proposal to promote the transfer of rural land management rights should guide peasants to fully understand the policy of land transfer, innovate land transfer mechanism to mobilize the enthusiasm of peasants,implement right registration of rural land, standardize and improve land transfer contract, establish and improve land transfer service system and market operation mechanism.
