网络环境下公民隐私权的保护——以我国《网络安全法》为视角

Protection of Citizen's Right of Privacy under Network Environment: From Perspective of China's Network Security Law

随着网络信息技术的飞速发展,侵犯个人信息并由此导致隐私泄露的现象屡见不鲜,隐私权的保护面临严峻形势。《网络安全法》的颁布施行使我国对公民个人隐私权的保护进入一个新阶段,它确立了个人信息保护的基本制度,进而保护隐私权。网络信息时代,仅仅依靠法律实现对隐私权的全面保护是不现实的,还应有其他的规则和措施。网络环境下对隐私权的保护宜采取立法规制为主、行业自律为辅的保护模式;对个人信息与隐私进行区分,明确个人信息中隐私的内容,采取差异化的保护措施;增强用户个人隐私权的保护意识并加强隐私权保护的国际合作。

With the rapid development of network information technology,the phenomenon of infringing personal information and causing privacy leakage is common.The protection of privacy is facing severe situation.The introduction of the network security law makes our country＇s protection of individual privacy of citizens enter a new stage.It establishes the basic system of personal information protection,and then protects the right of privacy.In the age of network information,it is not realistic to rely solely on the law to realize the overall protection of privacy,and there should be other rules and measures.The protection of privacy protection legislation should adopt the model of regulation based,supplemented by industry selfregulation under the network environment;to distinguish between personal information and privacy,the privacy of personal information in clear content,take measures to protect the difference;protection awareness of privacy of users and to strengthen international cooperation in the protection of right of privacy.
