摘要
土地流转实践中产生了租金高企、违规违约、强迫流转、改变用途、破坏利用、政府介入过度但公共服务提供不足等问题。土地流转中显示出的租期偏短、增速下降、风险较大、违约较多等现象反映了流转供求双方的各自担忧、利益诉求、政策期盼。农村土地流转市场应以落实"三权分置"改革目标和维护承包户权益为导向,及时修订土地流转相关法规和实施细则,健全基层土地流转交易平台,适当调整农业相关补贴政策取向,健全土地流转融资服务机制、土地流转相关配套保障制度以及土地流转纠纷预防、调解和处理机制,加大对土地流转过程中违法违规行为的监督和处罚力度。
In the long practice of land transfer,problems of high rent,rule breaking,forced transfer,change of land use and excessive government involvement with insufficient public service delivery have emerged. The phenomenon of short lease term,decreasing growth rate and high risk in land transfer reflect the worries,demand for interest and policy expectations of both sides of land transfer. Efforts should be made to implement the goal of "three rights separation"on rural land and safeguard the rights and interests of contractors,revise relevant regulations and implementation rules of land transfer,improve the trading platform for land transfer,properly adjust the policy orientation of agricultural subsidies,perfect the financing mechanism and supporting system for land transfer,improve the mechanism for preventing,mediating and resolving disputes in land transfer and strengthen supervision and punishment over illegal acts in land transfer.
