论我国政党协商程序的完善

On Perfecting the Procedure of Consultations Carried out by Political Parties in China

政党协商是中国共产党领导的多党合作与政治协商制度的重要内容,是我国社会主义协商民主体系的重要组成部分,政党政治协商必须制度化、规范化、正规化、程序化。当下我国政党协商的形式有三种,即会议协商、约谈协商与书面协商,协商程序归纳为协商规划提出、提前通知、提出意见建议、研究与反馈五大程序。然而,从应然意义上进行审视,目前我国设立的政党协商程序存在的问题是:缺乏确立的程序应遵循的原则;规范性程度差,随意性强;协商程序主体模糊,缺乏具体指向;缺乏明确的时效限定;协商主体的平等性有待改进。本文针对存在的上述问题,提出完善我国政党协商程序的原则与方法。

The practice of consultations carried out by political parties is the essential part of the system of multi-party cooperation and political consultation under the leadership of the Communist Party of China. The consultations should be carried out within the established institutions, regularized, meet the standards, and follow legitimate procedures. Currently, there are three forms of consultations carried out by political parties in China： consultations through formal meetings, consultations through interviews, and consultations through paper work. The procedures of consultation consist of making the plan for a consultation, issuing a notice before a consultation, having a consultation, investigating the opinions and suggestions gathered through the consultation, and giving feedback on the consultation. However, if the consultation procedure is examined from the perspective as it ought to be, we can find the following problems： there is a lack of principle governing the established procedures; the consultations fail to strictly follow the norms and regulations; the participants involved in the consultation procedure are not clearly defined; and the equality among the participants is in need of improvement. With an eye to these problems, we propose in this paper the principle and method to improve the procedure of consultations carried out by political parties in China
