摘要
惩罚性赔偿作为一项重要的法律救济方式,在惩罚和威慑违法行为人、有效保护受害人权益方面发挥着积极作用。文章从阐述惩罚性赔偿制度的基本问题出发,旨在分析该制度目前的立法漏洞,在借鉴外国先进经验的基础上,提出完善我国惩罚性赔偿制度的有效对策。
Punitive compensation is an important legal remedy approach which has positive function in terms of punishing and warning the law-breakers and pros rights. The basic issues of this system are discussed first to analyzetion. Based on the experiences in foreign countries, some effective measurements posed to promote the punitive compensation system in China.
