刑事侦查人员对犯罪现场的感知是通过结果和各种痕迹物证来推断犯罪行为的发生。犯罪行为分析在案件现场中的核心地位,是我们研究其价值的所在。现场重构是在现场分析的基础上对现场理性认识的客观真实再现。犯罪现场的分析与重构是对传统刑事侦查理论体系的深化和丰富,它继承了传统刑事侦查理论体系中的合理内容,剔除了原有的现场分析中的主观成分,有利于在实际侦查工作中对现场的主观因素、客观因素的划分与界定,对我们在新时期信息化和大数据背景下构建"智慧刑侦"工作有着广泛的实用价值和指导意义。

In recent years, the analysis on criminal scene and reconstruction of criminal scene has been widely applied in criminal investigation in our country, and it also has become a hot issue in the theoretic circles. The reconstruction of criminal scene is an activity of court scientific technology; it is scientific, unique, partial, and evident and differs from the analyses on criminal scene. The scientific conclusion of it has the abilities to provide evidences, and it is an expert＇s testimony regarded as evidences of proceedings.？With the deep-going research on the reconstruction of crime scene, the using of some sophisticated technology and methods, such as the technology of crime analysis, the portrait of crime psychology and the collection and using of proof are applied into the practice. That means they play a significant role in enforcement scientifically both in the scout work and theory. However, we should thoroughly reflect some deficiencies and inadequateness which grow in the reconstruction of crime scene.
