摘要
藏族非物质文化遗产的保护和救济成为难题。藏区非物质文化遗产保护应当引入法律救济。藏区非物质文化遗产法律保护主体理论,包括个人权利保护与以人文本、集体性权利保护及其救济需要、国家权力保护与救济职责。藏区非物质文化遗产法律救济文化的确立,相对应地涉及个人(群体)、立法机关、行政机关和司法机关等主体的参与和作用发挥,这些正是藏区非物质文化遗产法律救济文化构建的主体因素和文化因子。
The protection and restoration of Tibetan intangible cultural heritage become a problem.Therefore,it should be introduced by law relief cultural mechanism on Tibetan intangible cultural heritage protection.There are some demand of legal remedies subject on Tibetan intangible cultural heritage,such as the protection of individual rights and its remedies necessary,the protection of the collective rights and their needs and responsibilities of protection and relief in the state.Tibetan Intangible Cultural Heritage of legal remedies established some cultural ideas,correspondingly related to the aforementioned individuals(groups),the legislature,the executive and the judiciary and other subjects,to make them built factors and cultural factors of the Tibetan Intangible Cultural Heritage legal relief mechanism.
