摘要 《民办教育促进法》修改的核心是实施民办学校的分类管理,确立分类管理的法律依据。民办教育具有公共性,维护和引导民办学校的公共性发挥是民办教育立法的目标价值。公共性决定民办学校分类规范的标准,公共性差异为民办学校分类规范提供分析基础。公共性决定民办学校规范的重点,包括民办教育法的主体、民办教育法主体的权利、民办教育法主体的义务。 The revision core of Non-governmental Education Promotion Law is to implement the classification norms of private schools, establishing the legal basis of classification norms. Private schools have public nature, maintaining and guiding the public nature of private schools is the main value of private education legislation. Public nature determines the criteria for the classification norms of private schools, and the differences of public nature provide the analysis basis for the classification norms of private schools. Public nature is the key to determining the classification norms of private schools and also decides the subject of the private school legislation, the rights of the subject in private school legislation and the obligations of the subject in private school legislation.
