在"人大主导立法"的目标提出之后,全国人大专门委员会的立法职能被赋予重要的意义,专门委员会在立法中的作用也被视为人大主导立法的重要体现。分析表明,经由一系列制度设计,专门委员会开始主导本领域的综合性重要法律草案的起草与提出工作,专门委员会中的法律委员会通过统一审议制度保证了审议过程中的法制统一。专门委员会的立法职能中事实上形成了针对国务院系统的双重制约结构。该结构内含的矛盾性根源于制度设计者对于"人大主导立法"适格主体的不当界定,应当在厘清专门委员会在立法中的作用与人大主导立法的关系基础上,合理地围绕专门委员会的立法职能进行制度设计。

Since the role that the National People＇s Congress（NPC）should play the leading role in legislation was put forward,the legislative function of the NPC Special Committee has been given significant meaning.The role of the NPC Special Committee in legislation has also been equated with the leading role of the NPC.Analysis shows that through a series of system design,the NPC Special Committee has already started to dominate the draft and proposal of the comprehensive legislative bill in its own field.And the Legal Committee has also guaranteed the unity of legal system through the uniform deliberation.A dual restriction structure forms in the legislative function of the NPC Special Committee.The contradiction contained in the structure rooted in the improper definition of the subject of the leading role of the NPC in legislation.A reasonable institution design of the legislative function of the NPC Special Committee should be made based on the clarification of the relationship between the role of the NPC Special Committee in legislation and the leading role of the NPC in legislation.
