近三十年清代“采生折割人”律研究综述

The Research Review on the Article of“CAI SHENG ZHE GEREN”in Qing Dynasty in the Past Thirty Years

长期以来,学界对"采生折割人"律缺乏体系化的专题研究,多是在相关著述中略作提及或借其探究其他论题。随着西方理论的引入以及学科间对话的加强,学界尝试从医疗史、社会学、法律史等角度,重新解读杀人采生、律文衍变、采生谣言的传播及其与晚清教案的关系等问题。然而学界对"采生折割人"律的研究依然略显薄弱,采生折割的源流、由令到律的变迁、法律适用及社会各阶层对采生的构建等问题尚需做深入研究。

For a long time,there has been a lack of systematic research on the article of ＂CAI SHENG ZHE GEREN＂,which is mainly referred to in the related writings or used to explore other topics. With the introduction of western theories and the strengthening of Interdisciplinary dialogue,academic circle attempts to reinterpret ＂CAI SHENG＂,the evolution of article,the spread of rumors and its relationship with missionary cases in the Late Qing Dynasty from the perspective of medical history,sociology,legal history and so on. However,the study on the article of ＂CAI SHENG ZHE GEREN＂is still unsatisfied.Certain questions such as the origin of this article,the process of becoming national law,legal application,and the construction from all levels of society still need further study.
