新型支付方式下侵财犯罪的定性研究

The Qualitative Analysis of the Crime Behavior of Money Invasion under the New Payment Mode

随着网络技术的不断发展,人们的支付方式更加多样方便,与此同时,新型支付方式下的侵财犯罪应运而生。其中以窃取支付宝、微信钱包等第三方支付账户财产犯罪最为典型,对此类犯罪的定性应当以行为为划分依据区分:窃取支付宝、微信钱包等第三方支付账户内钱款应定性为盗窃罪;窃取与支付宝、微信钱包等第三方支付账户关联的银行卡内钱款应定性为信用卡诈骗罪。

With the continuous development of network technology, people’s payment methods are more diverse and convenient. At the same time, the crime of new type payment has emerged. Among them, crimes such as theft of Alipay and Wechat wallets and other third-party payment account assets are most typical, and the nature of such crimes should be based on the division of behaviors： for theft of money from third-party payment accounts such as Alipay and Wechat wallets should be characterized as theft; stealing money from bank cards associated with third-party payment accounts, such as Alipay and Wechat wallets, should be regarded as credit card fraud.
