On the Regulation of the Security of Artificial Intelligence by Administrative Law

随着人工智能技术的快速发展,人们对这一新兴技术滥用的担忧也日益加剧。面对人工智能的安全问题,未来的法律应该有所应对。从行政立法与行政法实践的角度,人工智能可能引发的安全问题给行政伦理和行政技术带来了冲击与挑战,现有的法律体系能否成功应对人工智能所带来的风险和不确定性,如何更加"智能"地对人工智能进行规制,无疑成了一个急需明确和亟待解决的紧迫问题。立足于风险防范,我们应该从总体思路和规则建构上思考人工智能安全的行政法规制问题。

With the rapid development of artificial intelligence, concerns about the abuse of AI have been increasing. The law has to figure out a new way to resolve security issues of AI. Within the perspective of administrative legislation and practice, security issues of AI have brought great impacts and challenges to administrative ethics and technical means. Whether the existing legal system is able to cope with risk and uncertainty in AI development, and how to intelligently regulate AI, have become the most pressing questions that must be defined and addressed. We should pay more attention to the regulation of AI by administrative law from general approach and rule-making to prevent risks.
