Differentiation,Coupling and Connection:Studies on the Operation of Three-dimensional Criminal Jurisprudence

我国刑法学研究应当实现从＂平面刑法学＂到＂立体刑法学＂的范式转换,以打破我国刑法学目前研究视野狭窄,理论层次不高的局面。立体刑法学应当以社会系统论作为理论基础,刑法作为法律系统的子系统,一方面通过运作上的封闭性实现刑法教义学的再生产,一方面通过认知上的开放性与其他法律系统的子系统实现衔接。这一衔接是刑法子系统与其他法律系统的子系统通过以若干联结点实现结构耦合来进行的,这就构成了立体刑法学的运作结构。

China＇s criminal law studies should realize the paradigm shift from two-dimensional criminal jurisprudence to three-dimensional criminal jurisprudence. The three-dimensional criminal jurisprudence should be based on the social system theory of Niklas Luhmann. On one hand,criminal law as a subsystem of law system reproduces the criminal doctrine through operational closure,on the other hand,it connects with other subsystems through cognitive openness. The three-dimensional criminal jurisprudence is a sort of academic investigation on these connections. The operation of three-dimensional criminal jurisprudence deals with the structural couplings of criminal law system and other subsystems through media. That makes the operating structure of three-dimensional criminal jurisprudence.
