摘要
"三权分置"要求坚持集体土地所有权,稳定土地承包权,放活土地经营权,实现土地经营权流转和抵押,具有深厚的法理依据。"三权分置"下农地承包经营权流转存在权能界限不清晰、交易关系无保障、法律规定不完善等法律风险。应明确确权登记的效力,强化合同的规范管理,完善相关的法律制度。
The ＂separation of three powers＂ requires adherence to collective land ownership, there is also a need stabilize the land contract fights, activate land management rights, and realize the circulation and mortgage of land man- agement rights, it has a profound legal basis. There are some legal risks in the circulation of rural land contract and man- agement rights under the ＂separation of three powers＂, such as the boundary of power is not clear, the trade relation is not guaranteed, the relevant laws and regulations are not perfect. We should make clear the validity of the indeed fight registration, strengthen the standardized management of contract, and improve the relevant legal system.
