摘要 我国的法学实践和学术研究并不重视经典阅读,对经典的忽视很大程度上影响了法学研究的品质。法学既非标准的社会科学,也不是典型的人文学科,但法学研究者都同意法学是一门面向实践的学问。根据对法学实践品格中“实践”的不同理解,在概念上法学可以被进一步区分为“实用技艺之学”、“问题解决之学”和“价值反思之学”。实用技艺意义上的法学无关经典,问题解决意义上的法学无须经典,而价值反思意义上的法学则高度依赖经典。这三种“法学”相对独立但又彼此关联,共同构成了法学这门学科。而在三者之中,价值反思的法学最能够体现法学“实践”实践品格因此也最具有学科典范。当代中国法学要在理智上成熟。必须超越简单实用的比较法式制度借鉴去挖掘制度背后的根本理据。这就要求法学研究者在阅读古今经典时放弃旁征博引的“索引式阅读”,转而面向事情本身进行理智投入的“反思性阅读”。 The ignorance of classics has crippled our legal scholarship. Legal scholarship is neither a standard social science nor typical humanity, but in general,lawyers agree that law is a practice-oriented discipline. According to three different conceptions of "practice" in law, the concept of law as a discipline can be further divided into " practical skill set of the legal practitioners ", " problem-solving oriented research" and " reflections of practical values". The practical skill set of the legal practitioners has nothing to do with reading classics. Problem-solving oriented research does not need classics. And reflections of practical values in law are highly dependent on the classics. These three conceptions of law as a discipline are relatively independent but related with each other - together they constitute the subject of law. Among the three conceptions, however, legal study as reflections of practical values can best reflect law's practice character and therefore make the paradigmatic case of legal study. To be intellectually mature and sophisticated, Chinese legal scholarship must go beyond the simple model of comparative law and reflect upon underlying rationales behind particular legal institutions. It requires legal scholars to engage critically with the ancient and modem classics and abolish indexation method of reading, and tum to explone the facts and engage in reasonable "retrospective reading".
