大学内部治理的困境与出路——基于陕西10所省属高水平大学章程的文本分析

The Dilemma and Solutions of the Internal Governance in Universities——An Analysis of the University Statutes in Ten Shanxi Provincial High-Level Universities

大学章程建设作为完善大学内部治理结构的核心,对建设现代化大学有指导性作用。本文通过对陕西省10所省属高水平大学的章程文本分析,分析了目前高校在章程建设过程中对大学内部包括党委、校长、行政人员、教师、学生等多元利益主体之间的权力配置和制度安排等方面所存在的问题,并从优化大学内部权力配置,回归学术本位、推进教授治学,建立多元共同治理机制三个方面,提出完善大学章程、推进高校内部治理现代化建设的建议。

As the core of the internal governance structure of a university, the construction of university statutes has a guiding role in building the modern university. Based on the analysis of the statutes of the high-level universities in Shanxi Province, this paper points out that the power allocation and system establishment among the universities, including the party committees, presidents, administrators, teachers and students and other aspects of the problems. This paper puts forward the solutions and suggestions to improve the university statutes and promote the modernization of the internal governance of universities from the following three aspects：optimizing the internal power allocation, returning to academic standards and promoting the teaching of professors and establishing the diversified common governance mechanism.
