新版《合同范本》在新形势下煤炭建设工程领域的应用

Application on new edition of model contract in the field of coal construction engineering under the new situation

《合同范本》在煤炭建设工程领域的使用大致经历了粗犷缔约、快速发展和稳步转型三个时期。较之以往,新版《合同范本》不仅集中反映了当前国内《合同法》立法的最新成果,也融合了专业建筑工程的相关知识。通过对新常态下合同解除问题及"互联网+"在建筑工程领域应用的探讨,结合现阶段煤炭行业特点,进一步发掘和优化范本使用方法,以期达到保障合同当事人合法权利义务、有效预防纠纷滋生的目的。

The use of model contract in coal construction engineering field assumably experienced rough contracting,rapid development and steady transformation of the three periods.Compared with the previous model contract,the new version not only reflects the latest achievements of the current domestic contract law,but also integrates the relevant knowledge of professional building engineering.through the investigation of the contract release problem under the new normal and the application of ＂Internet plus＂ in the field of architecture engineering,The author combined characteristics of current coal industry,further explored and optimized the use of the model,in order to achieve the purpose on protection of legitimate rights and obligations of parties to the contracts,and effective prevention of disputes.
