国有企业矿产品进出口贸易业务的法律风险防范

伴随着国家"一带一路"倡议的推行,国有企业正面临着前所未有的机遇,一方面"一带一路"沿线国家矿产资源丰富,另一方面国内矿业市场空间有限,国有企业必须走出去开拓广阔的国际矿业市场。鉴于矿业市场上下游产业链较长,本文以国际大宗矿产品贸易市场为切入点,综合归纳市场上风险成因及表现,围绕货物转移和货款收付两个环节,深入分析国有矿业公司在开展进出口贸易业务中存在的法律问题,并立足于海外风险合规管理的需要,从实证的角度提出建立一套完备的事前防范、事中控制、事后补救有序衔接、有效应对的法律风险防范机制。

The state-owned enterprises are confronted of the unprecedented opportunities with the implementation of ＂the Belt and Road Initiative＂. On the one hand, the countries along the area are rich in mineral resources, on the other hand, the domestic mining market is limited, and the state-owned enterprises must go out to develop a huger international market. In view of the industry of mining chain being long,this paper starts with the international bulk mineral products trade, summarizes the causes and performance of the market risk comprehensively around the goods transfer and payment, analysis the legal issues arisen in the import and export trade, and based on the needs of overseas risk compliance management, from the empirical point of view proposes to establish a completely and effective set of legal risk prevention and control mechanism for prevention and control and remedy.
