平台经济下劳动关系认定标准的重塑 被引量:17

Reshaping the Identification Standard of Labor Relations under the Platform Economics

摘要 平台经济在增添经济发展活力、促进就业的同时也对我国劳动法律规制提出了新的挑战。传统劳动关系认定标准不能适应平台经济下新型劳动关系的认定,亟须重塑。重塑平台经济下劳动关系的认定标准应当秉承有利于保护劳动者利益的原则,正确处理平台发展与劳动者利益之间的关系;应当先假设劳动关系成立,当出现某些重大的不能认定为劳动关系要素时,方能认定为劳动关系不成立;应当考察劳动者是否对用人单位存在实际影响能力,以及劳动者与用人单位的"人身从属性""经济从属性"和"组织从属性"。 The platform economics enhances vitality of the economic development and promotes employment of our country. However,it also challenges the labor regulations at the same time. The traditional identification standard is no longer suitable for identifying new labor relations under the platform economics and needs to be reshaped.Therefore,the principle should be followed which is beneficial to protect the workers' interests. And the relationships between the development of platforms and interests of workers should be dealt with correctly.Additionally,assumption should be firstly made that the labor relations are established unless there are some major factors cannot be identified. Moreover,it should be investigated about whether labors have actual influences on the employers.And the examination of the "personal affiliation","economic subordination",and"constitutional subordination"should be considered.
