我国收入分配立法基本原则之建构

收入公平分配立法的基本原则是收入公平分配立法活动应当遵循的根本准则,反映了收入公平分配立法正义、平等、秩序的价值取向与实现收入公平分配的宏远目标。收入公平分配立法的基本原则分为一般性原则和特殊性原则。收入公平分配立法活动应当遵循法治原则、民主性原则、统一性原则、科学性原则和正义原则等收入公平分配立法的一般性原则,还应遵循利益与责任同等分配原则、保障基本需要原则、合理适中原则、稳定性与适时性相结合原则、第三方立法原则等收入公平分配立法的特有原则。

The legislative principle of fair income distribution is the fundamental principle that legislative activities of fair income distribution should follow,reflecting its value orientation of justice,equity and order as well as its ambitious goal of realizing the fair income distribution. The fair income distribution legislative principle can be divided into two kinds—general principle and special principle.Besides general principles of fair income distribution such as rule-of-law principle,democratic principle,scientific principle and justice principle,legislative activities of fair income distribution should also follow special principles of fair income distribution such as principle of interest-responsibility equal distribution,principle of basic need guarantee,principle of rationality and moderation,principle of combining stableness and timeliness,as well as third-party legislation principle etc.
