知识产权人拒绝许可行为的反垄断法分析

知识产权人拒绝许可行为涉及知识产权法与反垄断法之间的关系,相关问题一直在理论与实践中存在争议。针对支配企业拒绝许可行为,美国最早采用关键设施理论来解决这一问题。在知识产权因素的影响下,知识产权人拒绝许可的行为同样可以适用关键设施理论。欧盟在拒绝许可行为中吸纳了关键设施理论,并且在后来的IMS案和微软案中丰富和发展了相关的考察标准,协调了反垄断法与知识产权法之间的关系。随着知识产权人拒绝许可行为域外理论分析与实践内容的丰富,《关于禁止滥用知识产权排除、限制竞争行为的规定》中有关行为标准也应当进一步完善,实现反垄断法与知识产权法立法目的的协调。

The refusal of intellectual property involves the relationship between intellectual property law and anti-monopoly law,and the relevant issues have been controversial both in theory and practice. Under the influence of intellectual property factors,the refusal of intellectual property may also apply the essential facility theory.The practices of the EU absorbed the essential facility theory in refusing permits and enriched and developed relevant inspection standards in later IMS cases and Microsoft cases and coordinated the relationship between the antitrust law and intellectual property law.Combined with the theory analysis and practical content extraterritorial enrichment of intellectual property refusing permits,the ＂Provisions on Prohibiting the Abuse of Intellectual Property Rights and Restrictions on Competitive Activities＂should also be further improved,to strike the balance between anti-monopoly law and intellectual property law.
