Research on Information Network Communication Right of Library

信息网络传播权属于著作权的一项重要内容。《信息网络传播权保护条例》第7条明确规定了数字图书馆的合理使用权,也对数字化技术的适用范围、服务对象和服务方式进行了限制,这不利于我国数字图书馆的发展。我国需要借鉴国外相关立法,充分利用图书馆自有的信息网络传播权,拓宽图书馆数字化技术覆盖的范围,扩大图书馆信息网络服务的对象和转变图书馆信息网络服务的方式,重构图书馆信息网络传播权的制度体系。

Information network communication right serves as one important part of copyright.The seventh article of Regulation on Protection of the Right to Information Network Communication stipulates the rational use of digital library.However,the regulation has also restricted the scope of application,service object,and service ways of digital technology,to some extent,it hinders the development of Chinese digital library.Therefore,it is necessary for China to learn from some related regulations of foreign countries,to broaden the scope of library digital technology,widen the service target of library＇s information network communication and transform the ways of service,and reconstruct the system of information network communication right of library.
