An Analysis of the Legal Policy Science of the Transformation of Old and New Kinetic Energy

作为关涉国计民生的治理改革和重大工程,新旧动能转换亟需法治的介入和回应,当前法学理论与实践的缺位源于传统法教义学对改革政策的研究排斥。法政策学为法学理论与实践顺畅进入新旧动能转换提供了研究立场与方法论。在明确新旧动能转换的政策主导必然性、政策与立法目标的一致性和地方治理改革的能动性之前提下,应建构新旧动能转换的法理基础、法治进路和法治目标,包括改革与法治互动融合、法与政策共生互洽以及法与政策的交互治理机制。最终实现法政策学理论与新旧动能转换实践的良性互动。

As a governance reform and a major project involving the national economy and the people＇s livelihood,the transformation of old and new kinetic energy requires the intervention and response of the rule of law. The current lack of legal theory and practice stems from the exclusion of the study of reform policies by rechtsdogmatik. Law policy science provides a research standpoint and methodology for the smooth transformation of law theory and practice into the transition of old and new kinetic energy.Under the premise of clearly defining the policy-led inevitability of transformation of new and old kinetic energy,the consistency of policies and legislative goals,and the initiatives of local governance and reforms,the basis of legal theory,the rule of law approach,and the rule of law objectives for the transformation of old and new kinetic energy should be constructed,including the interaction of reform and the rule of law,the symbiosis between law and policy,and the interactive governance mechanism of law and policy. Ultimatelythe benign interaction between the theory of law politics and the transformation practice of old and new kinetic energy can be realized.
