网络熟人社会的逻辑及其法治意义——从熟人社会规范式微说起

The Logic of Network Acquaintance Society and Its Significance to Rule-of-law-From the Study on Traditional Acquaintance Society

熟人社会中的面子、人情、熟人信用等,本可以在行为激励、社会团结和社会信用等方面发挥独特的秩序功能。然而,随着熟人社会的解体,这些传统资源的有效性正日益丧失,有些还出现了功能性变异,进而给我们的法治事业带来破坏性影响。所幸的是,在当下网络社会中,一种新的熟人社会形式(本文称其为"网络熟人社会")正在形成。与传统熟人社会一样,此种熟人社会形式也可以在行为激励、社会团结、社会信用等方面为法治提供间接的支持。与此同时,不同于传统熟人社会,这一新型公共空间又具有自身的独特性,因而可以在纠纷解决方面直接为法治作出贡献。

Some cultural normative mechanisms and action logics originating from acquaintance society such as Face, Human Rites and Based - on - familiar Trust have valuable functions on social order in behavior stimulation, social solidari- ty and trust as well. Nevertheless, with the collapse of Chinese traditional acquaintance society, their positive functions are disappearing or mutating, which is harmful to China- rule - of - law. Fortunately, the emerging of network acquaintance society provides us new opportunities. As a kind of public space, network acquaintance society contributes to behavior stim- ulation, social solidaritv and trust. And the uniaueness of this societv is helpful to the settlement of dispute.
