摘要
随着中国法治进程的加快,知识产权越来越受到人们重视。文章就教学实践中合理使用他人已发表作品问题进行初步研究,以期为学校及广大教师在将他人作品用于教学时提供一些提示和借鉴,降低教学活动的法律风险。主要介绍了著作权及其合理使用的含义,我国与国外为教学目的合理使用制度的现行规定,并从四个方面解析我国为教学目的合理使用制度,提出不足及完善建议。
With the acceleration of the rule of law in China, people pay more and more attention to intellectual property rights. This paper conducted a preliminary study on the fair use of other people' spublished works in teaching practice, aiming to give some tips and provide references for teachers and schools to avoid legal risks. This article mainly explains the meaning of copyright, the connotation of fair use as well as the current regulations of the fair use system in China and abroad. It analyzed the fair use system of China from four aspects and put forward some suggestions for improvement.
