Defects and Perfection of Administrative Coercive Measures for Public Security Traffic Management

公安交通管理行政强制措施是暂时对违反道路交通管理法律法规人员的人身、财产给予限制的行政行为。现有关于公安交通管理行政强制措施的规定,主要集中在对人身和财物两个方面,存在着"滥""散""乱"和"缺"等问题。出现这些问题是法治发展进程中的必然现象,立法机关未能明确行政强制措施的具体标准、法律规范之间的衔接及整体性不够,部分法律规范本身实践性不足等原因造成该权力行使混乱。要解决存在的问题,应该加强遵循法定原则和比例原则清理法律、提高执法者的理论素养、梳理交通管理行政强制措施种类等方面工作。

Administrative coercive measures for public security traffic management are a kind of administrative act to temporarily restrict the personal and property rights of those who violate the laws and regulations of road traffic control.The existing relevant provisions mainly focus on two aspects,namely physical and property,and have such problems as ＂misuse＂,＂looseness＂,＂disorderliness＂and ＂insufficiency＂.These problems are the inevitable phenomena in legal development,and they result from legislative body＇s failure in clarifying the specific standards of administrative coercive measures and the connection among relevant legal norms.Besides,defects in the measures＇ integrality and some legal norms＇ practicalness also cause the disordered execution of power.In order to solve these problems,it is necessary to make greater efforts to follow the principles of legal prescription and proportionality to sort out laws,improve law-executors＇ theoretical quality,and classify the variety of the administrative coercive measures.
