摘要
本文将城乡建设用地市场的制度变迁过程分为完全分割、法律调控、流转规范和对接统一四个阶段,将集体建设用地入市实践分为村镇集体建设用地简单流转、建设用地指标流转控制探索和统筹城乡的土地交易平台建立及探索三个阶段,并在此基础上,分析了当前城乡建设用地市场一体化的制约因素与现实困境,最终提出修改土地管理相关法规,清除现行法律法规政策障碍,明晰产权界定,坚持同地同权同价,缩小征地范围,完善增值收益分配和社会保障机制。
The market integration of urban and rural construction land is an inevitable historical development.The institutional change process of urban and rural construction land market is divided into four stages in this paper:the complete segmentation,legal regulation,standard transfer process and the docking unified process,and the practice of collective construction land entering the market into three stages:simple circulation of rural collective construction land,the exploration and control of the construction land,and the exploration of land transaction platform.On this basis,it analyzes the current restrictions and actual difficulties in the market integration and puts forward countermeasures.
