论档案治理视域下的公民利用档案权利实现

The realization of the rights of citizens utilizing archives under the view of archival governance

档案治理不仅需要档案行政管理部门、社会组织和公民的共同参与,而且需要对参与者的行为进行法律规制。在研究档案治理的体系建构和制度保障的过程中,以公民利用档案权利实现为切入点的研究具有重要意义。本文以公民利用档案权利为切入点,结合档案工作自身的保密性,剖析档案治理中公民利用档案权利实现的路径,进而明确档案治理视域下法律规制的价值导向与逻辑起点,为推动档案治理体系和档案治理能力现代化提供理论参考。

Archives governance not only needs the participation of archives administrative depart-ments,social organizations and citizens,but also re-quires the legal regulation of participants＇ behavior. In the process of studying the system construction and system guarantee of archives governance, it is of great significance to study the realization of citi-zens＇right to use archives.This paper takes the citi-zens＇ right to use archives as the breakthrough point, and analyzes the path of realizing the citi-zen＇s archival rights in the archives governance, combined with the confidentiality of the archival work itself. Furthermore, the value orientation and logical starting point of legal regulation in the field of archival governance are clarified, which provides a theoretical reference for promoting the modern-ization of archives governance system and archival governance ability.
