摘要
法学教育的核心内容有三个:一是培养学生对法律规范的领悟力和解释力,树立他们的正义感和培养他们的法治情怀;二是训练和提升学生对具体案件事实的分析和概括能力;三是培养学生对案件事实和法律规范符合性的判断能力。前者可以依靠日常课堂的教学来完成,而后两者则必须指引学生回到司法实践。其中,案例分析报告既可以作为法科学生毕业实习的总结,也可以作为学生毕业设计的考核根据,以案例分析报告替代传统的毕业论文写作形式,是法学实践教学的努力方向之一。
The core of legal education has three aspects: the first is to cultivate students’ understanding and interpretation of legal norms so as to establish their sense of justice and the rule of law; the second is to train and enhance their ability of analysis and generalization of specific case facts; the third is to cultivate students’ ability in the generalization of the facts in accordance with legal norms. The first one relys on daily classroom teaching, while the latter two requires preparing students for the judicial practice.The form of case analysis reports can be used as the summary for law students’ graduation internship and also as the assessment for their graduation design. The replacement of the case analysis report for the graduation thesis may be worth trying for the law practical teaching.
