基于权利要求分析的专利规避方法研究

权利要求包含专利核心技术的保护内容,是专利规避设计的重要依据。因此,分析专利权利要求的结构特点,并提出一种新的专利规避设计的方法。该方法包括三部分,首先,从专利权利要求书中获得保护的技术特征。其次,通过分析技术特征之间的关系,建立技术特征模型。最后,使用TRIZ来解决技术特征模型中出现的问题,获得新的解决方案。以红酒开瓶器为例验证方法的可行性。

Patent claims include core technical information,which are the important context for patent design around and being protected. Therefore, we analyzed the structure of patent documents and propose a new approach of design around. In our approach, the progress of design around include three steps. Firstly, we get the technical feature protected from claim part of patent document. Secondly, model of technical feature is built by analyzing the relationship between technical features. Then, we use TRIZ to solve the problem emerging in the model of technical feature, and get new solutions. The case study of wine opener is used to identify the validate of our approach.
