我国经济法体系研究现状探析

The Current Situation of the Research on Economic Law System in China

经济法的体系是经济法学基础理论研究的重要内容之一,主要解决经济法的内部结构问题。其研究程度直接关系到经济法基础理论研究的整体水平,亦关系到经济法学科体系及经济法学课程体系的构建。与其他学科相比,由于经济法学科仍然属于年轻的学科,理论体系尚不成熟,经济法体系研究亦是如此。近年来我国经济法学界围绕经济法的调整对象和经济法的机能等路径开展了关于经济体系的一系列研究,形成了百花齐放的代表性观点。随着研究的进一步深入和研究路径的进一步拓宽,关于经济法体系的理论研究不断进展,研究成果日渐丰富与成熟。但是仍然存在共识性成果不够集中、研究突破不大、关于经济法体系构成的认识存在交叉重复等问题。究其原因,主要在于经济法基础理论研究薄弱、研究路径和角度有限、研究顺序错位等。

Economic law system is one important part in the research on basic theories of economic law and mainly concentrates on the problem of solving the internal structure of economic law. Its research level directly concerns the overall level of research on the basic theories of economic law,and also concerns the construction of economic law subject system and course system of economic law. Compared with other subjects,economic law subject is still young,and its theory system is not mature enough. The research on economic law system is also the same.In recent years,the circle of economic law in China has made a series of research on the economic law system surrounding the questions about the adjustment objects of economic law and the function of economic law etc. With further depth and width of the research,the theory research on economic law system has made continuous progress with richer and ripened fruits. But there still exist some problems. The consensus results are not focused enough,the breakthrough of research is lacked,and the knowledge about the structure of economic law system is overlapping and repeated etc. The reason of these problems,when being examined,mainly lies in that the research on the basic theories of economic law is weak,the path and angle of research is limited,and the order of research is dislocated etc.
