摘要
《中华人民共和国环境保护法》以基本法的形式确立了生态补偿制度,全国各地都在不断进行生态补偿理论探究和实践,一些生态补偿实践项目也取得了成效。生态补偿机制涉及领域广、法律要素多、主体利益关系复杂,针对生态补偿机制的主要问题,必须从法律保障、补偿标准和路径等方面加以完善,才能形成生态补偿的长效机制,打赢蓝天保卫战。
The ＂ Environmental Protection Law of the People＇s Republic of China＂ established the ecological compensation system in the form of the Basic Law. The ecological compensation theory are constantly being explored and practiced throughout the country. Some practical projects of ecological compensation have also achieved results. The ecological compensation mechanism involves a wide range of fields,many legal elements,and complex relationships between subject interests. The main issues for the ecological compensation mechanism must be improved from legal guarantees,compensation standards and paths so as to form a long-term mechanism for ecological compensation and win the Battle of the Blue sky.
