中美同性婚姻法律背景对比研究

A Comparative Study on Legal Background of Homosexual Marriage in China and America

我国同性恋者有3900万~5200万人,80%的同性恋者被迫与非同性恋者结婚。有1600万到2500万"同妻",多数"同妻"知道丈夫是同性恋后,仍会因为爱情、社会舆论等原因维持婚姻。美国50个州都允许同性恋者注册登记,对同性婚姻经历了从排挤到接受的过程。通过对比中国与美国同性婚姻法律制度的价值取向、具体制度及制度程序,分析中美同性婚姻法律背景的差异,得出我国目前仍不具备承认同性婚姻合法化法律背景的结论。

There are 39 to 52 million homosexuals in China,and 80% of them are forced to marry to non-homosexuals. The number of the gay＇s wives reaches 16 to 25 million,the majority still maintain their marriage because of love,public opinion and other reasons after knowing the fact that her husband is a gay. 50 states of America let gays get married,and gay marriage position has also undergone a process from exclusion to acceptance. By comparing the value orientation,specific regulations and system procedures of same-sex marriage legal system in China and America,this paper analyzes the differences of their same-sex marriage legal background,then comes to a conclusion that China still does not have the legal background for legalization of recognizing same-sex marriage.
