业主委员会“成立难”问题及其破解——一项基于业主交易成本的分析 被引量:4

摘要 从交易成本的角度看,当前国内存在的小区业主委员会"成立难"问题说明业主委员会成立的交易成本过高,限制了业主的相关活动。本文在划分成立业主委员会交易成本构成的基础上,运用交易成本理论对H市业主委员会"成立难"问题的实证调查结果进行深入分析后发现,有限理性和不确定性、机会主义、资产专用性、委托代理机制失灵等因素是导致业主交易成本过高的主要原因。应通过完善相关法律规定、强化责任约束机制、强化研发商和物业相关责任、扶持业主委员会联合会组织的发展等措施来降低业主的交易成本,逐步破解业主委员会成立环节出现的问题。 From the point of view of transaction costs,the problems of "difficulty in establishment" of the owners' committee in the country at present indicates that the transaction cost of the owners' committee is too high,which limited owners' related activities.This paper,based on the division of the transaction cost structure of the owners' committee,uses transaction cost theory to analyze the empirical findings of H City owners committee's "establishment difficulty" problem,finds out that factors such as limited rationality and uncertainty,opportunism,asset specificity and failure of principal-agent mechanism are the main reasons for the high cost of the owner's transaction.We should reduce the owner's transaction cost by improving the relevant laws and regulations,strengthening the responsibility constraint mechanism,strengthening the assistance and cooperation of the property service enterprises,and supporting the development of the organization of the owners' committee,gradually solve the problems arising from the establishment of the owners committee.
