摘要
既有住宅增设电梯是一项推进老旧小区适老性改造的重要举措,但在实践中却遭到部分业主的反对,致使这一政策一度搁浅。本文通过对既有住宅增设电梯的性质分析以及对业主表决权、投票权的对比研究认为,既有住宅增设电梯是对业主共有部分的处分行为,应由业主采用双重多数决的通过规则进行表决,业主表决权的范围应根据增设电梯占用的公共部分属性确定。同时,为保护少数反对者的权益,建议适用双重多数加有利害关系业主同意的通过规则。
Adding elevators to existing residential buildings is an important measure to promote the renovation of old residential areas,but some owners are opposed to other obstacles in practice,resulting in the policy being stranded once.Based on the existing residential properties analysis and the creation of an elevator to the owners the right to vote,the voting power of the comparative study,draw the conclusion:both residential elevator is a total additional action on the part of the owners,owners should adopt double majority vote by the owners of the voting rules should be based on the scope of additional public attribute part of elevator take the determination.At the same time,in order to protect the minority rights and interests of the owners affected by the resolution,it is recommended to apply the double majority with the consent rules of interested owners.
