考试招生制度改革对教育考试执法提出了更高要求。教育考试执法不应照本宣科式地简单套用和被动适用法律,只有自觉而且恰当地运用价值判断、利益衡量,使之与"三段论"相辅相成,才能充分保障教育考试执法与法律精神相符。既服务于教育考试立法所秉持的最大限度维护社会公平正义、促进公序良俗、维护法律威严的目标,又能够充分有效保障考生的合法权益。

The reform of the system of examination and enrollment has put forward higher requirements for the law enforcement of education examination. The education examination law cannot simply apply to echo what the books say consciously and properly using the value judgment,the interests of the measure,and make the ＂syllogism ＂complement each other,law enforcement of the examination and the spirit of the law can be fully guarantced. It not only serves social justice and justice,promotes public order and good customs,but also protects the legitimate goal of law,and fully protects the legitimate rights and interests of examinees.
