摘要
专利质量评价可以从众多专利中甄别出高质量专利,辅助企业了解技术发展现状、确定研发方向和新产品开发方案。本文对专利质量评价方法作了系统梳理,比较分析了其优缺点。针对专利质量的模糊性和无法直接观察的特点,在高质量专利特征分析的基础上,给出了表征专利质量的两个代理变量,进而提出了基于诉讼专利数据建立专利质量评价模型的研究方案。实证部分,构建了心脏起搏器领域专利质量评价模型,用专利转让数据对模型的适用性进行验证,最后给出了该领域专利质量的评价结果。
Patent quality evaluation can identify high-quality patents from numbers of patents,which can assist enterprises in grasping the overall situation of technology development,focusing on the direction of research and development and optimizing new product development program. Methods of patent quality evaluation are systematically reviewed and their advantages and disadvantages have been compared in this paper. In terms of ambiguity and indirect measurement of patent quality,two proxy variables are given to represent patent quality based on the analysis of the high-quality patents' features. As a result the research plan,a patent quality evaluation model is proposed based on litigation patent data. In the empirical study,the patent quality evaluation model of pacemaker is constructed,and applicability of the model is verified by transfer of patents. Finally,the evaluation results of patent quality in pacemaker are given.
