基于法律保留原则的高校校规制定权限研究

高校校规制定权限问题主要涉及如何在学术自由权利保障、学生权利保障、社会公共利益和国家利益保障之间实现合理平衡。虽然高校校规制定权来源于作为宪法基本权利的学术自由权利,但是学生权利保障以及最低要求的学术水准和教育质量等社会公共利益和国家利益保障,都要求高校自主办学领域必须适用法律保留原则,高校校规制定权由此受到一定的限制。

The constituting power of university regulations mainly involves how to realize the reasonable balance between the rights of academic freedom,the rights of the students,the public interests and the national interests.Although the constituting power of university regulations comes from the rights of academic freedom as the basic rights of the constitution,the protection of the rights of the students,the public interests and the national interests such as the minimum required academic standards and quality of education,require that the principle of legal reservation should be applied in the field of independent running of universities.Therefore,the constituting power of university regulations is limited.
