摘要
在马来西亚、新加坡和我国香港地区引进外来高等教育资源、建设区域性高等教育中心的过程中,法律起着不可或缺的作用。综观这些国家和地区有关外来高等教育资源引进的法律,尽管模式和具体内容各有不同,但对我国不无启示。在立法理念上,对外来高等教育资源的准入规制应采取更为开放和进取的态度;在准入规制上,应采取分类准入管理;在具体规制制度设计上,应以教育质量保障为中心;为保障法律切实得到实施,应对违法办学设定更为严厉的法律制裁措施。
Laws play an indispensible role in regulating inbound higher education in Malaysia,Singapore and Hong Kong in their efforts to build themselves into regional international education hubs.Despite the differences of laws governing inbound higher education in Malaysia,Singapore and Hong Kong,the following inspirations can be drawn for us:to adopt the openness and proactive attitudes towards the inbound higher education;to adopt classified regulation based on the nature of the entities running the schools and courses;to center on the quality assurances to formulate specific rules;and to provide severe legal sanctions against the violations of relevant rules.
