基于远程专家库基础上的工程造价纠纷调解

Engineering cost dispute mediation based on remote expert database

常见的工程造价纠纷调解往往因申请纠纷调解的当事人不利的一方存在世俗的偏见,质疑参与调解的工程造价管理部门、造价协会(以下简称"调解机构")或专家的调解独立性及公正性,导致调解结果很难被接受,造成调解的效率及成功率较低。如何在最大程度上确保调解的独立性及公正性并提高调解的效率及成功率,是当前调解机构面临的难题。笔者在从事多年工程造价纠纷调解的实践经验的基础上,提出由远程专家库中随机抽取专家组建临时调解委员会参与调解工程造价纠纷,并从建立远程专家库、调解原则、调解流程、远程专家调解以及调解机构二次调解等方面阐述了调解的独立性、公平性、公正性、公开性及权威性等,客观公正地维护了当事人双方的合法权益,促进当事人双方心服口服地达成一致意见,最终乐于接受调解结果,从而提高了调解的效率及成功率,希望能为建筑行业解决工程造价纠纷的调解提供参考。

Since the adverse party applying for dispute mediation has worldly prejudice, and questions mediation independence and impartiality of engineering cost management management and cost association （hereinafter referred to as the ＇mediation organization) or experts, the mediation result can not be accepted easily, and the efficiency and success rate of mediation are low in common engineering cost disputes mediation. How to ensure the mediation independence and impartiality maximally, and improve the efficiency and success rate of mediation are the problems faced by the current mediation organizations. The author proposes to randomly select experts from remote expert database to construct temporary mediation committee participating in mediation of engineering cost disputes on the basis of practice experience of mediating engineering cost disputes for many years. Mediation independence, equality fairness, openness, authority, etc. are described from the aspects of establishing remote expert database, mediation principle, mediation flow, remote expert mediation and secondary mediation of mediation mechanism, etc. Legitimate rights and interests of both parties are maintained objectively and fairly, thereby drivi the mediation results, thereby improving the mediation ng eff both parties to reach consensus sincerely. Finally, they are willing to accept iciency and success rate. It is expected that the paper can provide reference for mediating engineering cost disputes in the construction industry
