MOOC版权合理使用与图书馆应对策略研究

The Fair Use of MOOC Copyright and the Coping Strategies of Library

MOOC课程被图书馆所收录并供读者使用,对版权合理使用规则提出了严峻挑战。然而,MOOC的存在具有合理性,其具有公益性的特点,有利于促进教育目标的实现,也符合经济学价值的追求。为了避免MOOC资源的利用与版权法中的合理使用规则之间冲突,我国应当调整合理使用规则的立法规定,通过建立有效的合同制约机制,引入版权许可使用制度,MOOC平台和图书馆采取必要的技术措施等方法,解决图书馆MOOC版权面临的合理使用问题。

MOOCs are collected by the library and are provided to the readers,which poses a severe challenge to the rules of the rational use of copyright. However,there is certain rationality in the teaching of MOOC,which is of public interest and is conducive to the realization of the educational goal and the pursuit of economic value. In order to avoid the conflict between the use of MOOC resources and the fair use of copyright law and rules,China should establish effective contract restriction mechanism and introduce the copyright licensing system by adjusting the legislative provisions of fair use rules,and the MOOC platform and library take the necessary technical measures to solve the problem of fair use of MOOC copyright in library.
